I am reporting a potential safety defect involving water intrusion into the amplifier location on my BMW F33. According to the dealer's diagnosis, water entered the area containing the amplifier, causing failure of the audio system and the loss of audible safety warnings and alerts. As a result, the vehicle no longer provides audible safety notifications that are intended to warn the driver of potentially hazardous conditions. I believe this condition is caused by a design defect that allows water intrusion and creates an unreasonable safety risk. Research indicates BMW has issued technical service information addressing this condition. I have not taken possession of the vehicle because I am concerned about operating it without functioning audible safety warnings.

The vehicle was taken to a third dealer, where it was diagnosed with a failed engine electrical system, digital motor electronic control unit, and transfer case failure. While driving at highway speed on [XXX] I went to put my windows up. Without touching anything else my seat moved backward and I was unable to reach either pedal. Fortunately I was able to maneuver to a point where I was able to regain vehicle control. Obviously this was a life threatening situation which could have been disastrous. There was no auto correction by the vehicle. This was reported to BMW of Barrington , IL and serviced on XXX. No specific explanation has been provided. This is just one of many issues with this vehicle that appear to be related, and escalating in severity. I can't determine how they are related, if at all. I don't trust the safety of this vehicle and am not convinced BMW to date has performed a complete root cause analyses from the date the vehicle was put in service. This issue is causing added anxiety and this being my only reliable transportation is troublesome. Rear window does not work. This car collects water from the windows which pools inside the window panel. Eventually, the pooled water damages the window motor and window regulator. Once the window stops working, the convertible top no longer works. This issue is reported all over youtube and google searches. The worse part is that to fix this, mechanics have to manually bring down the convertible top. It is at the dealership, Wesley chapel BMW, they sent me a message that it won’t be ready today because there is recall and an issue but they have not told me what it is. I was researching and i saw what’s called “sudden unintended acceleration.”

I pulled out onto Southside Blvd. My brakes failed, my driver’s front of the car hit a Waste Management garbage truck right back tire and cut the sidewall of the tire. The engine was racing, the truck pulled off the road, and I had sudden unintended acceleration. I immediately turned into a strip center and my car was racing through the strip center, the brakes were not working, the car controls were not working, and I turned the ignition switch off and the car stopped. The car had to be towed. Presently my insurance company has issued an estimate to repair the cosmetic issues, but not the mechanical issues.
