My 2015 BMW Z4 vehicle has a coolant pump safety recall. It reportedly could cause a short circuit and thermal event or fire. I bought the vehicle while living elsewhere and am now in a small community with 4 major automobile dealers but not BMW. The nearest BMW dealer is about 220 miles away. I contacted that dealer. The service rep said it is 1.5-2 day repair and a loaner vehicle may be available. The repair time sounds wrong but is what she said. She said the dealership would not work with any facility close to me to make the repair so I must drive the 440 plus round trip miles for BMW dealer repair. Repair of 1.5 to 2 days means I would either need lodging and waste least 2-3 days of my time or drive back home with a 2nd trip to the dealer to return a loaner and get my car, 880 miles and many hours driving. Even a 1 day repair means 440 miles and many hours. Called BMW Recall Hotline at [XXX] & explained my situation. They declined help saying the dealer decides how the repair is handled. I called BMW Customer Service [XXX] . They declined help & said a BMW dealer must repair unless it wants to work with another repair facility. I submitted a web-form message on BMW's corporate website online message portal outlining the problem and requesting help to get the safety recall fix completed in a convenient manner; asked to escalate if possible. They replied 3 days later declining to help saying: "The recall would have to be performed at a BMW dealership. Unfortunately, towing assistance is not available for this recall. If you would like to have the repair performed at another mechanic, It would be a non-reimbursable out of pocket expense. I would not be able to submit an escalation in this matter because it does not meet the criteria to be escalated. I apologize about an inconvenience this may cause." This seems unreasonable for a safety recall that could cause a car fire. Can NHTSA please help me obtain a reasonably convenient repair from BMW? I have written to you previously to advise of repeated engine issues with my vehicle, a 2011 BMW Z4. I also included invoices of work that was done over time to correct a likely Engineering flaw that caused excessive fuel injector failure. In 2021, there was a 10 year extended warranty to replace them. Prior and after the warranty work, there was almost constant engine misfires and engine warning lights resulting in decreased engine performance, and low oil lights that came on every 300+ miles driven. My recent issue with the car involves a starter quitting while driving at 70mph on [XXX]. It was terrifying. It's impossible to put into words that death was imminent. On [XXX], we were traveling to Orangeburg, SC when the car suddenly "died" on the highway. Once we recovered from our shock, we had the vehicle towed to a local shop. The owner advised us that it needed a new starter. Once that was replaced, the car started with a severe screeching noise. After further assessment, it was determined that there was a bent piston rod and that the engine would have rebuilt or replaced. I, a former automotive Engineer, believe that there was an inherent design flaw that caused the car to excessively use oil. Interestingly, I purchased a new BMW and as a condition of sale, was required to sign a document that I would not sue BMW or participate in a class action lawsuit. I was not provided with a copy of the form that was signed, but doubt that it would be upheld in court. BMW needs to be held accountable for their products and their performance. My grill shutters are faulty and the problem has been persistent and the vehicle is only at 30,000 miles. This is the same part that was issued an extended service contract by BMW for various other models. I believe my model is rare enough to not be included but it should. The existing recall/warranty is “SIB 01 12 19 FRONT GRILLE UPPER/LOWER ACTIVE AIR FLAPS: LTD WTY EXT TO 15 YEARS/150,000 MILES” and I believe mine should be included in this as it is the same engine as these various models. The grill shutters are experiencing the same fault and they do not open and close properly as the models listed. I receive code P05AF which is signals the lower shutters are not closing.

We received notice of this recall, and while the Manufacturer administratively states there is no remedy, they then list the remedy quite simply which is to replace the Vanos Bolts. I called around to dealers and other Euroshops and every one of them has the parts to remedy the recall. Because of this it is clear that both the remedy and parts required for this recall is in fact available. Given this information this means BMW is either negligently prolonging listing the remedy as available or worse, purposely doing so in order float money that they do not yet want to shell out to dealers to fix these recalls. I have contacted BMW customer relations and while they do not dispute that the parts to remedy this recall are readily available, they refuse to administratively list the recall remedy as available. They refuse to offer to replace or refund the vehicle as well. This is a violation of federal law and our rights as a consumer, whereas the manufactures must proceed in a timely fashion and while they are granted time to develop a remedy and procure the parts needed, there is no part of the law that allows them to unilaterally administratively refuse to list the remedy as available when in fact the remedy is available as are the parts to repair it readily available. Resolutions we will accept on this matter are exactly what is required by the manufacturer by law. Correctly list the recall remedy as available so we can have it remedied at a dealer, and if BMW refuses to do that, they are violating our rights to repair this in a timely fashion and must either replace of refund.
