In a letter dated September 15, 2015, a consumer submitted a petition to the National Highway Traffic Safety Administration (NHTSA) alleging that software defects caused an accident experienced by his wife in their model year 2010 Lexus HS250H vehicle as she was attempting to park the vehicle. The petition requests that NHTSA have Toyota correct software defects in their electronic throttle control software and then issue a national recall of all effected [sic] vehicles and have Toyota replace the old faulty code with the new safer code. Toyota Motor Engineering & Manufacturing (Toyota) is recalling certain 2010 Lexus HS 250h Hybrid vehicles. A component within the hybrid transaxle assembly may short circuit and result in a reduction or a complete loss of available power for moving the vehicle.

Risk: A complete loss of motive power can increase the risk of a crash.

Toyota Motor Engineering & Manufacturing (Toyota) is recalling certain model year 2006-2011 Toyota RAV4 vehicles manufactured October 31, 2005, to September 7, 2010, and 2010 Lexus HS250h vehicles manufactured July 6, 2009, to August 26, 2010. The affected vehicles have rear suspension arms (rear tie rods) with adjusting lock nuts that may have been improperly tightened after servicing. As a result of being loose, the arm may have thread damage and may rust, possibly leading to the failure of the arm and an abrupt change in the vehicle's alignment.

Risk: Failure of the rear tie rod could cause a loss of vehicle control, increasing the risk of a crash.

PETITION FOR A DEFECT INVESTIGATION UNDER 49 U.S.C. 30162 BY INTERESTED PERSON FOR STANDARDS AND ENFORCEMENT (2 CD' S ENCLOSED). *SMD ACCORDING TO THE CONSUMER'S WIFE, THE ACCIDENT WAS CAUSED BY SUDDEN ACCELERATION. AS SHE WAS SLOWLY TURNING RIGHT INTO A PARKING SPOT, THE VEHICLE SUDDENLY ACCELERATED AND CRASHED INTO A BRICK BUILDING. THE FORCE OF THE CRASH CAUSED THE AIR BAGS TO DEPLOY. THERE WAS SO MUCH DAMAGE TO THE VEHICLE, IT WAS DECLARED A TOTAL LOSS. ACCORDING TO THE EDR RECORDING, THE LAST FIVE SECONDS BEFORE THE CRASH, IT SHOWED SHE WAS APPLYING LIGHT PRESSURE TO THE GAS PEDAL UP UNTIL THE LAST .8 SECONDS. FOR THE LAST .8 SECONDS THE EDR SHOWED HER FOOT WAS ON THE BRAKE AND THE THROTTLE WAS A T NEARLY MAXIMUM VALUE. DURING THE LAST .8 SECONDS THE VEHICLE WENT FROM 5 MPH TO 9.9 MPH AND THE ENGINE RPM WENT FROM 1200 TO 2800.

The contact stated while driving approximately 45 MPH in traffic, he depressed the brake pedal for slowing traffic ahead however, the brake pedal became firm and failed to respond as needed. The contact stated he depressed the brake pedal with more force and the vehicle started slowing down but did not stop as needed. The contact felt as if the brake pedal was jammed. The contact stated that the ABS and check brake lights were illuminated. The contact stated that the vehicle failed to stop as needed and only the forward movement of the vehicles in front kept him from crashing into the vehicle. The contact had the vehicle towed to an independent mechanic where it was diagnosed and determined that the brake booster needed to be replaced. The vehicle had not been repaired. The manufacturer had not been informed of the failure. The contact and the independent mechanic researched online and related the failure to NHTSA Campaign Number: 13V235000 (Service Brakes). 2010 LEXUS 250HS BRAKE ACTUATOR. DRIVING ALONG A CITY STREET GOING 55 MPH. SLOWING DOWN TO APPROACH A STOP LIGHT. IMMEDIATELY AFTER DEPRESSING BRAKE PEDAL THE RED BRAKE LIGHT AND ABS LIGHT COMES ON. MY PEDAL GOES STRAIGHT TO THE FLOOR AND I HAVE NO BRAKES AND ALMOST CRASHED MY CAR INTO THE REAR END OF ANOTHER CAR. I HAD TO HIT THE CA SHIFTER INTO B MODE AND FLY INTO THE GRASS TO STOP. THERE WAS A CANAL RIGHT THERE I ALMOST WENT INTO. THIS WAS A RECALL IN 2010 AND VIN SPECIFIC. I HAVE READ A MILLION FORUMS THAT THIS IS A CHRONIC ISSUE WITH THIS CAR. MY CER HAS 81,000 MILES ONLY. LEXUS CORPORATE SAID THEY WILL NOT COVER THE 2,400 PART/LABOR. I THINK THIS IS EXTREMELY DANGEROUS SAFETY ISSUE THAT THIS PART CAN GO OUT WHILE DRIVING. I DRIVE OVER A HIGH BRIDGE TO GET TO WORK. WHAT WOUND THEY HAVE DONE WHEN GETTING A LAW SUIT WHEN I'M BELLY UP IN THE OCEAN IF BY BRAKES WENT OUT ON THE BRIDGE. THIS CAR HAD A "ABS UPDATE" IN 2010 BECAUSE THIS MODEL WAS HAVING ISSUES THEN. THEY CLEARLY DON'T CARE ABOUT OUR LIVES. I WILL NEVER FEEL SAFE DRIVING THIS CAR AGAIN. IF THIS HAPPENS AND I DIE BECAUSE I HAVE TOTAL LOSS OF BRAKES FOR A SECOND TIME WHO'S THE DUMB ONE? I DIDN'T KNOW IF IT HAD TO DO SOMETHING WITH THAT BUT I TOOK IT INTO A LEXUS DEALERSHIP TO GET IT FIXED FOR THE RECALL. IT DIDN'T HAPPEN AFTER THAT AGAIN UNTIL DECEMBER OF 2018. SO BOTH TIMES I HAD LOCKED MY CAR, CAME BACK TO MY CAR EVENTUALLY, AND SAW MY WINDOWS WERE DOWN. DIFFERENT HEIGHTS. NOTHING WAS TAKEN OR BROKEN.
