NHTSA Vehicle Safety Complaint – 2023 Volvo XC40 Recharge Plus Vehicle: 2023 Volvo XC40 Recharge Plus BEV VIN: [[XXX]] Date of Incident: [XXX Approximate Mileage: [26,9333] Location: [[XXX]] – occurred while going downhill Component: Service Brakes, Electric; Parking Brake; Vehicle Speed Control Summary: I experienced complete loss of braking while driving my 2023 Volvo XC40 Recharge on a highway. One Pedal Drive was active. After coasting downhill for approximately 1.5-2 minutes with no accelerator or brake pedal input, I applied the brake pedal to slow for traffic and discovered the vehicle had no braking capability. The pedal was firm but the car did not decelerate. There were no warning lights, messages, or alerts before or during the failure. This resulted in a collision with other vehicle Damage to my vehicle to the front left etc.]. Police responded and generated report #[XXX]. Additional Details: 1. Drive mode: One Pedal Drive was ON at the time of incident. This matches the failure mode described in NHTSA Recall 25V-392 for 2020-2026 Volvo BEV/PHEV models, which warns of total brake loss after 1 minute 40 seconds of coasting in One Pedal Drive/B mode. 2. No warnings: No dashboard alerts, sounds, or messages occurred before brake failure, inconsistent with a safe design. 3. After incident: Braking function returned intermittently after the vehicle came to a complete stop, also consistent with 25V-392. 4. Recall status: My VIN currently shows no open recalls on NHTSA’s lookup tool. However, 2023 XC40 BEV is explicitly listed in NHTSA Recall 25V-392. I was never notified to disable One Pedal Drive or that my vehicle was unsafe to operate. Vehicle Status: I still have possession of the vehicle and it has not been repaired. I pulled into a parking spot with a concrete barrier pole at a pharmacy to pick up my sister. I had my foot on the brake while she was getting into the vehicle when the vehicle suddenly accelerated forward crashing into the pole. I have also had an incident where I tried to start the vehicle and could not get the vehicle to go from park to reverse. This is concerning that there could be some faults in the electrical system, sensors or brakes.

Brake system failed. I was NOT in one pedal mode. I have up to date software. After break system failed I was unable to put vehicle in park. Parking break could not be applied. Could not turn car off or lock doors. I was driving on interstate when it occurred. I got multiple warnings on display. I was lucky to pull over and not crash.

The contact owned a 2024 Volvo XC40. The contact stated that his wife was entering a parking lot at approximately 10 MPH when she heard the vehicle engine abnormally revving and the vehicle independently accelerated. The vehicle drove through the parking lot and crashed into a tree. The contact stated that the driver's and passenger front air bags deployed, and the front collision avoidance had not engaged. The contact stated that the vehicle crashed into the tree almost at the center of the front bumper and grill. The hood had been crushed, the grill cracked, and the bumper had been torn off. The contact stated that the police arrived on scene but did not write a report since no other vehicles were involved. The contact stated that his wife had scrapes and bruises on both arms and scrapes on her nose and forehead. The wife was not attended to by EMT, but later went to the ER for neck and back pain. The vehicle was towed to an impound lot and later declared a total loss by the contact's insurance provider. The contact had contacted the manufacturer, who sent a technician to download information from the vehicle computers. The contact stated that a summary was released by the manufacturer that indicated that the crash was a driver error. The failure mileage was approximately 8,000.

Driver assist failed and brakes failed when vehicle veered to left on its own..Brakes and steering failed when trying to correct failure.. Overcorrection caused vehicle to veer off road and over a sign and continue for approximately 50 feet. Vehicle is currently at State Farm towing lot. My safety and others were put at risk with "reckless" driving. The problem has not been reproduced. A State Farm claims adjuster will inspect the vehicle today 2/18/26 or tomorrow. No warning lamps or messages appeared.

On two separate occasions, brakes failed completely in snow. Vehicle did not appear to be hydroplaning, and anti-lock function did not kick-in despite the pedal being floored. Pumping had no effect either. Safety sensors around the car should have detected motion even if the wheels were locked-up and should initiate anti-lock procedures as well. Distance traveled (at low speed due to snow and heavy traffic) was well over 100 feet. Emergency stopping feature finally engaged anti-lock brakes about 1/2 second before impact. To avoid a second crash (someone two vehicles ahead caused a pileup) a year later, driver had the wherewithal (and space) to leave the roadway when brakes failed to even slow the vehicle.

SUPPLEMENTAL INFORMATION FOR ODI#11708898. I am providing additional documentation to this ODI case. I had to create a new complaint since there appears to be no way on-line to add this information. Gunther Volvo has not provided ANY status updates of my vehicle which has been in their possession since Sunday, January 4, 2026. The Director of Customer Experience, Nyam Smith had not responded to my email sent on 1/4/2026. Volvo Customer Care had assigned a case # for towing and for the safety incident but both the dealership and Volvo Customer Care have been unresponsive. I did not receive responses to my texts to the dealership asking for any updates, and Nyam Smith said in an email that I needed to get any updates from Volvo Customer Care. I called them to get an update but Pablo had no update and said he had to call the dealer! The Service Tech I had talked to on 1/5 about the car left me a voice mail at 5:05 PM on 1/5 stating that the foreman has been in contact with Volvo Engineering and that they had a few questions -- how many times had this issue occurred, how did I get the car to stop running and they requested a photo of the shoes I was wearing. I sent that photo that evening but I never received any response from numerous texts asking for a status. They have not provided a courtesy loaner for the past 15 days so I have had to incur incidental rental charges. 1/9/26, I spoke to Jocelyn at Volvo - she was unable to give any updates but she sent me a form (one of the questions asked where the vehicle was!) -- I emailed the completed form that same day but received no acknowledgement from them until 1/15. They sent me a form authorizing an investigation of my car. I have not received any further communication from Volvo Cust. Care or the dealer. They are withholding diagnostic. data (BCM/ECU logs following the unintended surge event on 1/4/26. I am calling the dealer 1/19 to speak with Vasil Blagoev, Service Mgr. for a status

On 01/04/2026, while operating a gas-powered 2024 Volvo XC40, the vehicle experienced a catastrophic Sudden Unintended Acceleration (SUA) event while stationary at a red light. With the service brake fully depressed, the internal combustion engine began to surge and rev uncontrollably, making loud noises. The engine torque increased in direct response to increased brake pressure, eventually overcoming the braking system and forcing the vehicle forward into the 3-way intersection. Technical Details: Brake-Throttle Override (BTO) Failure: The vehicle’s safety logic failed to prioritize the brake signal over the uncommanded throttle increase. Shifter Interlock Malfunction: During the surge, the electronic gear selector was unresponsive, preventing shifting into Neutral (N) to disconnect power. Shifting capability only returned once the vehicle was brought to a forced stop. Prior Symptoms: Intermittent "idle flaring" and surging were noted 48 hours prior to the failure. Safety Risk: The vehicle moved into traffic against my intent and physical input, posing a high risk of collision. The car was towed by Volvo Road Assistance on 1/4/26 to the Volvo dealership later that evening. This incident mimics the "Powertrain Control System" defects currently documented in NHTSA Campaign 25V392 and the Becker v. Volvo class action, suggesting the software defect extends to ICE (Internal Combustion Engine) models. The car is currently at the Volvo Dealership for diagnostics. The service intake person has not provided an update on whether they have been able to duplicate the issue. I do not know what diagnostics have been performed on the car at this point. There were no warning signs or messages prior to the failure. Some minor surging had been noticed a couple of days before, but this latest incident was catastrophic and a safety risk. I felt trapped in my car.

I pulled over right side of street to park behind a parked vehicle to a visit house across the street. Was too far out from curb so I backed up about 12-15 feet or so. Put car in drive and slowly started to drive toward curb when car suddenly accelerated very hard. I turned steering to left to avoid hitting the car in front, straightened car out but could not stop it until it stopped about 20-30 feet down the road. Brake was not stopping my car. The acceleration was something like being on a ramp to get on highway and pressing pedal down to get to highway speed. It was a very hard acceleration. Very frightening. I got an appointment tomorrow for volvo service to look at this. Drove the car after this happened and today without any incident. I bought the car new in Mar 2024 and have NEVER experience this.

am writing to formally report a serious issue involving the sale of a Certified Pre-Owned Volvo by a franchised Volvo dealership in Pennsylvania that I believe violates consumer protection standards and certified vehicle regulations. On [XXX], I purchased a 2024 Volvo XC40 from Volvo Cars Fort Washington, represented and sold to me as a Certified Pre-Owned (CPO) vehicle. However, I have since discovered that this vehicle had an active safety recall as of May 1, 2025, prior to the sale. The recall was related to a malfunction in the safety camera system, which could potentially lead to severe accidents and endanger the driver and passengers. Despite this open recall, the vehicle was still certified and sold to me without any disclosure of the safety issue. I only learned about the recall after experiencing a problem with the camera system and independently seeking service. This violates the core standards of manufacturer-backed CPO programs, which clearly state that no certified vehicle may be sold with an unresolved safety recall. I believe this sale represents a misrepresentation of the vehicle’s condition, a failure of duty to disclose, and a potential violation of consumer protection laws in the state of Pennsylvania. I am requesting that this matter be investigated and that appropriate action be taken against the dealership for selling a vehicle as “certified” when it did not meet the required safety and certification standards. On Wednesday, July 16, 2025 I was sitting at a stop light, using the Auto Hold system. A few minutes later, my car took off and accelerated on its own and hit the rear of a truck. I hit the truck so hard as he was sitting at the light as well, it pushed his vehicle into the vehicle in front of him. I was unable to stop my Volvo, it was like it took full control over.

On July 1st 2025, while slowly reversing out of my driveway at approximately 3–4 mph, the vehicle’s collision detection system errantly detected an imminent collision. Despite there being no obstacles, vehicles, pedestrians, or objects in the vehicle’s path, the system abruptly engaged the automatic emergency braking (AEB). This sudden and forceful braking caused me to experience whiplash due to the unexpected jolt. There was no prior warning or indication of a malfunction, nor any alert from the vehicle indicating why the braking occurred. After exiting the vehicle and inspecting the surroundings, I confirmed there were no obstructions behind or near the vehicle. This appears to be a false positive detection by the vehicle’s collision avoidance system. This incident raises serious concerns about the reliability and safety of the AEB system, particularly in low-speed reversing situations. An erroneous activation of this kind can result in injury to the occupants, potential rear-end collisions (in other traffic scenarios), and may also contribute to driver mistrust of critical safety features.

I turned on a side street just bf the traffic light and coasted to a stop amd turned car off. Airbag not operative light came on and seatbelts were tightening then loosening. The component that failed was the Brake pedal, it was unresponsive while driving on the freeway, it was hard to push and the vehicle would not come to a complete stop. My safety along with my daughter was put at risk due to nearly colliding into several vehicles due to not being able to stop vehicle. I had to tow the vehicle to the nearest shop where it is currently. During the incident the brake light came on. The shop where the vehicle is currently is stating that it appears to have a faulty Brake Vacuum Pump.

On Wednesday morning [XXX] at [XXX] I was parking my 2023 Volvo XC Recharge in the parking lot on Stearns Wharf in Santa Barbara where I was meeting my walking group for our regular morning walk on the pier and along the waterfront. While I was slowly finishing pulling into a parking spot, with my foot solidly on the brake, the car suddenly lurched and accelerated. It jumped the parking spot wooden stop and then jumped the orange iron barrier that divides the parking lot from the pier road. It felt as if I were suddenly on a runaway horse. My instincts kicked in as the car bounced fully onto the pier road, and I immediately turned the car so that I would not crash through the other barrier on the ocean side of the pier road and dive into the ocean. I immediately drove the car back into the lot and parked it. The pier is not a standard asphalt/concrete road or lot. It is wooden beams placed one after the other. It is very bumpy and the speed limit is 10 miles per hour, but usually you cannot even drive that fast because it is so rough and bumpy. I was going the slowest you can go just before coming to a full stop in my parking spot, with my foot fully on the brake, when the sudden acceleration occurred. It is a very bumpy and uneven surface and maybe that contributed to a failure in the vehicle monitoring system or automatic braking system. I feel incredibly fortunate that this malfunction did not cause more damage than a blown tire. I am grateful there were no pedestrians or cars in the path of the car and that I was not parked on the ocean side of the parking lot. This could easily have been a fatal and catastrophic incident. My trust in the car to function properly is severely compromised. Volvo kept the car for 2 months while investigating. I went through a car wash and then pulled into the first parking spot near the vacuum cleaners. As I was braking and coming to a stop, the car suddenly lurched forward and accelerated on its own. Despite pressing the brake pedal multiple times, the car did not stop until it went about 15ft. To avoid hitting the building wall directly in front of me, I swerved to the left. The car collided with the metal pole supporting the vacuum cleaner structure, causing significant damage to the entire side of the vehicle, and also clipped the corner of the building on the right as it went through the area. There were no warning lights, messages, or other indications of an issue before the incident. I have videos of the incident from the car wash. -The issue involves unintended acceleration, potentially related to the accelerator pedal sensor (APS), throttle control system, or braking system. It may also be electrical, as similar issues in 2021 and 2022 Volvo XC40 Recharge vehicles were reported due to water damage and corrosion in the cable harness, leading to unintended APS signals. The vehicle is available for inspection upon request. -The vehicle suddenly accelerated without input causing a collision. To avoid hitting a building wall in front of me, I swerved to the left, and the car struck the metal pole supporting the vacuum cleaner structure. The impact caused significant damage to the side of the car and clipped the corner of the building as well. This incident could have resulted in severe injury or damage had anyone been nearby or if the car had collided directly with the building (which held the car wash electrical panel). As it stands I have a stiff neck and some PTSD. -No, the problem has not yet been reproduced or confirmed by a dealer or service center. It's at the collision center. -No, the vehicle has not yet been inspected by the manufacturer, police, insurance, etc. -No warning lamps, messages, or other symptoms appeared before/during/after the incident.

I am a new leasee of a Volvo XC40 Recharge (leased September 13, 2024). When starting my car from a decline on my driveway, or in a parking spot on a decline, after putting the car in reverse, the car immediately surges forward 20 inches before I have to hit the brakes again to make it stop from hitting a car in front of me. The same behavior occurs if I am parked on an incline and put the car in drive - it immediately surges backwards and I have to hit the brakes to make the car stop. This issue puts my and other cars parked in front or behind me at risk of being hit when trying to leave a parking spot. This issue was confirmed by the dealer (see attachment) and replicated on another XC40 Recharge that the dealer tested it on. The service rep stated that "As far as Volvo is concerned at this time the vehicle is working as designed and this is a normal characteristic of the vehicle." I am not sure why they would say this as a car should not surge forward when it reverse or backward when in drive. No other car in the history of my driving cars has ever done this.

My wife pulled into a neighbor's driveway and put the car in Park. The car stopped. She reached over to the passenger's seat to pick up an item and the car lurched forward, crashing into the closed garage door before she could stop it. There were no warning lights alerting her that this would happen. She later told me, though, there had been previous instances of the car "bucking" after she had put it into park. The incident clearly posed a safety risk to my wife and others. Had someone been standing in front of the car when this happened, they could have been seriously injured or killed. Had the car not stopped after hitting the garage door, my wife, too, could have been seriously injured or killed. Had this happened in an area such as a parking lot, others also might have been injured. Volvo advised me not to file a police report at this time. The vehicle was inspected at Wallace Volvo in Stuart, Florida, and would be available for additional inspection. Volvo claims to have found liquid on internal parts. The larger, and more important question, though, is how the vehicle’s design could have allowed that to happen. Facts clearly point to a design flaw. The vehicle design clearly allows liquid to reach the parts in question and create the problem we experienced. If Volvo had designed the vehicle with a “tight” interior – a design that would have protected internal parts and not left them vulnerable – no amount of liquid in any amount from any source under any circumstance would have ended up in the vehicle’s internal parts. In my claim to Volvo, I asked that they make repairs to assure that this never happens again. They conceded that they did perform "repairs" to the vehicle but called it a "one-time good will gesture." I also asked Volvo to pay for the body damage to my vehicle and the damage ($2,364) caused to my neighbor's garage door by the malfunctioning vehicle. Volvo has refused to compensate me for the damage caused by their malfunctioning vehicle.

The brake systems have failed repeatedly on this vehicle, and have been replaced by the manufacturer TWICE since purchase (April 28, 2023). Brakes continued to intermittently freeze or lose pressure, so car is now classified as a lemon. However, as we have waited months and months for the lemon process to complete, the transmission began to fail. At first, we had incidents of the car seeming to shift into neutral at speeds of 30-40 MPH. The car’s engine would rev and yet forward propulsion would become coasting. Lifting foot from accelerator and then putting fit back on would often result in the gear “catching” and the car lurching into gear. On the most recent and dangerous iteration of this transmission/engine problem, when merging onto an interstate and traveling at 45-50 MPH, I attempted to accelerate and merge. Instead of downshifting to give me more power, the car entered a seeming neutral state (both hands were on the wheel, indicator said I was in Drive). The engine revved and yet the car coasted. I was unable to pull into traffic, on a very short entrance ramp. I pulled my foot off the gas pedal, waited a second, and put it back on. The car lurched into gear and shot forward. We have stopped driving this car while awaiting Volvo’s agreed upon lemon law payout. The dealer will not fix the car, given its lemon status. The buyback company, Sedgwick, takes no responsibility. We are fortunate enough to be able to afford a new car while awaiting the payout. But had we not been able to, these transmission/engine problems could easily have caused an accident. No other person should be in danger from these cars. The service manager at our dealer states that they are in the process of multiple XC40 buybacks right now. Volvo has a problem and it is simply buying back these cars. I will list the date of the most aggregators transmission issue (the merging problem) below.

While entering a parking spot my car suddenly accelerated and crashed into the wall in front of me in spite of my pushing my brakes 100%. The car never went into the automatic braking system before I applied the brakes, the seat belt never engaged and the air bags on the driver's side did not deploy. If I had not braced myself against the steering wheel my chest would have sustained a major injury. I am being treated for pain in my neck, arm and leg as a result of the crash. The sudden unintended acceleration has occurred in prior years of this model and after my model year as well and have been reported to NHTSA. Both my insurance and the manufacturer inspected the car. There were no warning messages or symptoms of a problem before this incident.
