NHTSA complaint #11761650 — an unverified report by a vehicle owner.

2022 BMW 540I Jackson Heights, NY

POWER TRAIN

Rear differential failed, internal gears compromised. Noticed problem when going into gear. Vehicle no longer is able to go in gear and will shut off engine. No indication lights prior to failure. Vehicle showed drivetrain error as soon as it had failed. Vehicle was in main road when failure occurred, placing vehicle at risk. Upon BMW technician inspection, there were no leaks, fluid was clean but internal gears were compromised. BMW dealership in New York is unable to provide a problem cause. The rear differential failure caused driveshaft failure which also required replacing. However, the dealer is unaware as to how this could have happened, especially since this vehicle has been dealer-maintained. With no prior indication of failure and dealer unable to explain reason of failure, I request this to be investigated as there may be other vehicles experiencing the same failure.

POWER TRAIN

On XXX, while stopped at a traffic light, I accelerated normally in my 2022 BMW 540i. After moving only a few feet, I heard a loud metallic clank from the rear of the vehicle. The vehicle immediately lost all ability to propel itself. It would still shift between gears, but pressing the accelerator would not move the vehicle. A drivetrain warning appeared after the failure. There were no meaningful warning symptoms beforehand. The vehicle was towed to an authorized BMW dealer (Paul Miller BMW in [XXX]), where the rear differential/driveline was identified as the apparent failed component. The vehicle remains completely inoperable and is available for inspection. NHTSA identifies this vehicle as subject to Recall 26V525. The recall concerns excessive wear at the connection between the driveshaft and rear differential and warns that the defect can result in loss of power to the rear wheels and possible vehicle rollaway. The failure I experienced appears consistent with the condition described in that recall. The recall is currently listed as “Recall Incomplete, remedy not yet available.” I contacted BMW North America and the servicing BMW dealer because the vehicle has already experienced the apparent recalled failure and cannot be driven. The dealer advised me that BMW became involved but, because the recall is presently “unclear,” BMW would not provide documentation confirming whether the failed rear differential is covered. I was further advised that the only current option is to pay for the repair and seek reimbursement once the recall remedy becomes available. This leaves me with an immobilized vehicle subject to an active federal safety recall involving the same driveline components that failed, but with no current remedy or definitive coverage determination. My third-party service-contract administrator is also declining to authorize the repair because BMW has announced responsibility for the recall condition. The contact owns a 2021 BMW 540I. The contact stated that while driving at an undisclosed speed, the accelerator pedal was depressed; however, the vehicle failed to accelerate as intended. There was an abnormal sound coming from the vehicle before the vehicle lost motive power. No warning lights were illuminated. The contact stated that the vehicle failed to respond while in drive(D) or reverse(R). The vehicle was towed to the dealer, where it was diagnosed with a driveshaft failure. The contact was informed that the driveshaft needed to be replaced. The vehicle was not repaired. The contact referenced NHTSA Campaign Number: 21V046000 (Power Train); however, the VIN was not associated with the recall. The manufacturer was made aware of the failure. The contact was advised to contact the NHTSA Hotline to report the failure. The failure mileage was approximately 66,700.

POWER TRAIN

While turning my 2022 BMW 540i onto a busy, 50 MPH road, the vehicle suffered a catastrophic drivetrain failure, without any physical trauma such as encountering a curb or pothole. The car experienced a total and immediate loss of motive power (propulsion), leaving me coasting in live traffic. This created an extreme safety hazard as I was unable to accelerate or maintain speed to clear the roadway safely. The failure occurred immediately after a significant temperature stress: taken from a heated garage, driven with no issue for 40 minutes, then parked in 15 degree weather for two hours, then complete failure within moments of starting up after the two hour cold parking block. My reading since the incident reveals that BMW quietly switched a critical drivetrain part from a composite/plastic material to metal in later 2022 production runs, due to temperature tress failures precisely as I experienced. This 'silent fix' suggests a known design defect in early 2022 models that poses a recurring risk of sudden propulsion loss. BMW did not do a recall for this, but they should have: I and other drivers were in real danger when my car spontaneously lost all motive ability in high speed traffic.

2018 BMW 540I Forest Hills, NY

POWER TRAIN

On September 11, 2024, I took my vehicle to BMW of Great Neck for a tire and rim job under insurance. BMW failed to return my lug nuts, leaving my vehicle in an unsafe condition. It took nearly a month for them to provide the missing lug nuts. Upon inspection, each wheel had fewer than the required 5 lug nuts, creating a serious safety risk. On September 24, 2024, I had to return to BMW due to a Tire Pressure Monitor (TPM) sensor issue, which should not have occurred after their September 11th service. Instead of addressing the issue, BMW dismissed it and suggested I get it fixed elsewhere. BMW’s own manager confirmed my vehicle was returned in this unsafe condition. If I hadn’t noticed, this could have resulted in wheel detachment, loss of control, or a crash. Additionally, after a routine oil change on December 27, 2024, BMW’s Multi-Point Inspection (provided January 12, 2024) revealed: •A missing stiffening plate, which supports chassis integrity. BMW stated this could cause chassis damage. •Coolant expansion tank & vent hose leaks, affecting vehicle cooling. •Fluid leaks, which could worsen over time. Contradiction in BMW’s Diagnostics & Evidence of Negligence: •The 1/12 Multi-Point Inspection contradicts the 12/27 diagnostic image I captured from service advisor Kevin Guo. •BMW failed to identify these issues on 12/27, despite servicing my vehicle that day. •This suggests either a misdiagnosis, negligence, or an attempt to cover up damages. Safety Concerns & Inspection Status: •The wheel issue put my safety at risk, and BMW has not taken accountability. •The stiffening plate issue affects vehicle stability, which could lead to handling problems or structural failure. •These issues were confirmed by BMW’s own inspection report on 1/12/25, contradicting the 12/27 diagnostic. BMW of Great Neck’s negligence directly compromised my vehicle’s safety. I request an investigation into their repair practices to prevent this from happening to others.

2018 BMW 540I Fort Lauderdale, FL Crash 1 injured

POWER TRAIN

The vehicle was at a complete stop, when the gas pedal was tapped to move forward slightly the vehicle suddenly accelerated out of control. There was an attempt to apply the brakes, but the vehicle continued to accelerate and "Drive Train Malfunction" began to flash on the dashboard of the vehicle. The vehicle proceeded to accelerate as it jumped a curb, crashed into a ditch, before finally becoming lodged in a fence and coming to a complete stop when half of the vehicle was lifted off of the ground. The driver of the vehicle suffered a fractured back as a result of the incident. We have reported this incident to BMW and are awaiting a response from the manufacturer. The vehicle has been inspected by the driver's insurance and, while we do not have a report from them yet, the vehicle was totaled.

POWER TRAIN:AUTOMATIC TRANSMISSION:LEVER AND LINKAGE:COLUMN SHIFT

The contact owns a 2019 BMW 540I. The contact stated while driving 60 MPH, the contact pressed the button on the gear shifter and the vehicle inadvertently shifted into NEUTRAL. The contact then shifted back into DRIVE. The contact continued driving with no further issues. However, the contact concern was that there should be no reason for the gear shifter to change gear with little to no pressure on the gear shifter from an inadvertent touch of the button on the gear shifter. The contact took the vehicle to the local dealer to be inspected however, the mechanic was unable to duplicate the failure. The vehicle was not repaired. The manufacturer was made aware of the failure. The failure mileage was approximately 43,500.

MY CHECK ENGINE LIGHT CAME ON FOR CHASSIS STABILIZATION AND DRIVETRAIN MALFUNCTION. I TOOK IT TO THE DEALERSHIP AND THEY TOLD ME THEY REPAIR WOULD NOT BE COVERED UNDER WARRANTY. DEALERSHIP ALLEGES A RODENT GNAWED ON A ENGINE WIRING HARNESS. FROM WHAT I GATHER FROM THE DEALERSHIP THIS OCCURS FREQUENTLY. THE MANUFACTURER IS AWARE OF THIS PROBLEM BUT HAS FAILED TO MAKE NECESSARY DESIGN CHANGES TO MAKE THESE WIRING HARNESSES INACCESSIBLE TO RODENTS. MY CASE IS NOT THE WORSE CASE SCENARIO BUT A FIRE COULD HAVE STARTED, MY VEHICLE COULD HAVE BECOME INOPERABLE AND CAUSE AN ACCIDENT WHILE OPERATING THE VEHICLE. I WOULD LIKE TO REQUEST FMVSS BE UPDATED TO ADDRESS THESE PRODUCT DESIGN DEFECTS. A WIRING HARNESS THAT CAN POTENTIAL DISABLE REGULAR FUNCTIONS OF THE VEHICLE COULD RESULT IN DEATH SHOULD NOT BE EASILY DISABLED BY A RODENT.

MY TRANSMISSION WOULD NOT ACCELERATE OR MOVE. I HAD THE TRANS REBUILD AND 2 YEARS LATER THE SAME PROBLEM. THE TRANS HAS LOST GEARS 1-3 AND REVERSE, MULTISTATE REPAIRED THE TRANS AGAIN 2013, IFOR THE SECOND TIME, IT NEVER WORKED AFTER REPAIRS. THE ENGINE LIGHT STAYS ON, BMW SAYS I NEED NEW TRANS AND ENGINE. WHEN I LOOKED UP RECALLS FOR 540I, IT STATES THE SAME TRANS PROBLEM AND IT SHOULD BE REPLACED. WHEN I LOOK UP ENGINE THERE ARE KNOWN ENGINE PROBLEMS WITH 540I, NOT MY VIN. I ALSO HAVE ELECTRICAL ISSUES, WHICH HAVE A RECALL ON 540I, BUT NOT MY VIN. ALSO ISSUES WITH COOLANT, WHICH IS ANOTHER KNOWN ISSUE, BUT NOT MY VIN. I HAVE TRIED TO GET BMW TO DIAGNOSE, BUT THEY ONLY RECOMMEND REPLACING ALL PARTS AT MY EXPENSE, EVEN THOUGH THERE IS A HISTORY OF THESE TYPE OF ISSUES WITH THE 540I, 1999 CARS. I WANT BMW TO REPLACE ALL KNOW ISSUE PARTS AT THEIR EXPENSE AND THEY HAVE REFUSED DUE TO MY VIN, NOT WILLING TO ADD VIN TO THE ISSUE. ALL ISSUES WITH MY CAR ARE KNOWN ISSUES FOR 540I 1999 CARS.

POWER TRAIN

INCIDENT #1 2010: ACCELERATED THE VEHICLE TO 75MPH TO ENTER FREEWAY. TOOK FOOT OFF GAS AND VEHICLE CONTINUED TO ACCELERATE. ENGAGED CLUTCH TO STOP ACCELERATION AND RPM CONTINUED TO RISE TO THE LIMITER POINT (APPROX 5500 RPM). PULLED OVER, STARTED CAR AND ENGINE IMMEDIATELY WENT TO THE RED LINE. ON INSPECTION, A PLASTIC PART ON AN ACCELERATOR CABLE HAD CRACKED, CAUSING THE ACCELERATOR TO LOCK IN THE FULLY OPEN POSITION. IF THE CLUTCH HAD NOT BEEN ENGAGED (I.E. IF THIS CAR HAD AN AUTOMATIC TRANSMISSION), THIS COULD HAVE RESULTED IN A COLLISION AND POSSIBLE INJURIES OR FATALITIES. INCIDENT #2 12/2/2012. STARTED CAR AND PULLED AWAY FROM CURB. AT ABOUT 3-5 MPH THE STEERING WHEEL LOCKED. STOPPED CAR, TURNED OFF IGNITION AND STARTED IT AGAIN. THE WHEEL UNLOCKED BUT THERE WAS AN AUDIBLE CLICKING SOUND WITHIN THE STEERING COLUMN. CAREFULLY DROVE ABOUT ONE MILE TO HOUSE AND TURNED OFF ENGINE. STEERING WHEEL LOCKED AGAIN AND CAR COULD NOT BE STARTED. THE WHEEL LOCKING WHILE THE CAR WAS BEING DRIVEN WAS A CONDITION THAT COULD HAVE RESULTED IN A COLLISION AND POSSIBLE INJURIES OR FATALITIES.

2003 BMW 540I at 92,000 miles Reston, VA

POWER TRAIN

DRIVING HOME ONE EVENING, I NOTICED A BINDING FEELING BEING TRANSMITTED THROUGH THE DRIVE-TRAIN, DRIVE-ABILITY DID NOT SEEM TOO AFFECTED, OTHER THAN THE ODD BIND BEING FELT. THE NEXT MORNING UPON START-UP, THE CAR BEGAN MAKING A LOUD, RPM SENSITIVE WHINING NOISE. I SHUT THE CAR OFF AND DROVE ONE OF MY OTHERS. WHEN I OPENED THE HOOD IT WAS OBVIOUS THAT THE SERPENTINE BELT WAS NOT ALIGNED CORRECTLY. THROUGH FURTHER OBSERVATION, IT WAS CLEAR THAT THE POWER STEERING PUMP MOUNTS WERE BROKEN. THE BROKEN MOUNTS CAUSED THE PUMP TO PUSH FORWARD AND NOT BE ALIGNED. THE BELT WAS BEING CHEWED UP IN THE PROCESS. WHILE REMOVING THE PUMP I NOTICED THAT THE BOLTS HOLDING IT IN PLACE WERE LOOSE. THESE LOOSE BOLTS WERE ALARMING AND COULD HAVE RESULTED IN THE POWER STEERING PUMP LOOSENING EVEN FURTHER CAUSE THE BELT TO JUMP. IN MY OPINION, IT IS COMPLETELY UNACCEPTABLE FOR THIS TO HAVE HAPPENED. THE FACT THAT A MOLDED PIECE OF ALUMINUM WOULD FRACTURE AND BREAK IS ALARMING, AND THE LOOSE BOLTS IS EVEN WORSE. IT IS VERY POSSIBLE THAT THE BELT COULD HAVE JUMPED (HAS HAPPENED TO FELLOW 540I DRIVERS) WHICH WOULD HAVE RESULTED IN NO POWER STEERING.

WHEN SHIFTING INTO REVERSE, THERE IS A HESITATION BEFORE TRANSMISSION SHIFTS IN. HESITATION TIME IS INCREASING. ALSO, WHEN STEPPING ON PEDAL FOR AGGRESSIVE ACCELERATION OR PASSING, VEHICLE HESITATES, THEN "CLUNKS" VIOLENTLY INTO GEAR. MECHANICS HAVE STATED THAT IT IS A COMMON PROBLEM THAT THEY SEE WITH THIS VEHICLE AND TRANSMISSION. SOLUTION IS TO REPLACE WITH A BRAND NEW TRANSMISSION(PARTS COST $5000.00).NOTHING DONE YET TO REMEDY PROBLEM DUE TO INCREDIBLE COST. ALSO, SHIFT LEVER SAFETY BUTTON NO LONGER WORKS, ALLOWING VEHICLE TO BE ACCIDENTALLY SHIFTED OUT OF DRIVING GEAR INTO OTHER GEARS. MECHANIC STATED THAT INTERNAL PIN BROKE AND THE WHOLE SHIFT LEVER HAS TO BE REPLACED WITH A PARTS COST OF $300.00. OTHER PROBLEMS: ; POWER SEAT CONTROLS FAIL CONTINUOUSLY, DASH DISPLAY LIGHTS NOT WORKING, ...

POWER TRAIN:AUTOMATIC TRANSMISSION

I OWN A 2001 BMW 540I. I WILL PUT THE CAR IN DRIVE, THE CAR WILL MOVE REALLY SLOW, AS I GIVE IT A LITTLE GAS TO GO, THE CAR WILL ONLY REV UP THEN JUMP INTO GEAR. THIS WILL CAUSE A VERY STRONG JERK TO THE CAR. THE CAR ONLY HAS 70,000 MILES, I FEEL THAT IT IS MUCH TOO SOON FOR A $65,000 CAR TRANSMISSION TO GO BAD. I TOOK THE CAR TO BMW TO FIND OUT THAT I NEED TO REPLACE THE TRANSMISSION. (COST $5600) I HAVE NOT FIX THE CAR IN HOPE THAT I WILL FIND A SOLUTION FOR BMW TO FIX IT.

POWER TRAIN:AUTOMATIC TRANSMISSION

I BOUGHT A BMW 540I IN 1996 USED AT 45,000 MILES FROM A DEALERSHIP. WHEN SHIFTING INTO REVERSE TRANSMISSION WOULD BE DELAYED TEMPORARILY BEFORE ENGAGING. NOW I WAS NOT INFORM THE OF THE TECHNICAL BULLETIN AND DUE TO POOR TRANSMISSION FLUID, NOW AT 90,000 MILES THIS CAR WOULD NOT GO INTO REVERSE , SHIFTER WOULD SLIDE, AND CAR WOULD NOT MOVE. NOW THERE IS A IDENTICAL EXPERIENCE WITH AN OTHER CONSUMER CASE# 889281 WITH THE NHTSA. MY CAR HAS BEEN IN FOR OTHER RECALLS NOW I WOULD LIKE TO KNOW IF THEY FAILED TO DO THERE PART AND IN MAKING SURE THAT THE TRANSMISSON PROBLEM FLUID OR OTHER TECHNICAL PROBLEMS WAS TO BE TAKEN CAR OF BY THE DEALERSHIP BEFORE IT BECAME AN ISSUE.
