LATCHES/LOCKS/LINKAGES:DOORS:LATCH

BMW of North America, LLC (BMW) is recalling certain 2005-2008 745i, 745Li, 750i, 750Li, 760i, 760Li, and B7 Alpina vehicles equipped with both the Comfort Access and Soft Close Automatic options. In these vehicles, the doors may appear to be closed and latched, but, in fact, may inadvertently open.

Risk: The door may unexpectedly open due to road or driving conditions or occupant contact with the door. The sudden opening may result in occupant ejection or increase the risk of injury in the event of a crash.

POWER TRAIN:AUTOMATIC TRANSMISSION

BMW is recalling certain model year 2005-2008 7-Series vehicles, equipped with the Comfort Access option, and manufactured August 23, 2004, through July 24, 2008. The affected vehicles have an electronic key and an electronic connection between the gear shifter and the transmission (shift-by-wire) that automatically shifts the transmission to Park when the driver presses the Start/Stop button to shutdown the engine. If the driver presses the engine Start/Stop button 2 or 3 times within a short time interval, the system may shift the transmission to Neutral rather than Park. If using the electronic key (Comfort Access mode), there would be no protection from the ignition interlock that prevents key removal if the vehicle is not in Park.

Risk: If the driver exits the vehicle with the transmission in Neutral and the parking brake is not applied, the vehicle may rollaway. Unattended rollaway incidents often result in a crash or cause injury to pedestrians attempting to stop or enter the vehicle or to other bystanders in the path of the vehicle.

The contact owns a 2008 BMW 750LI US. The contact stated that while driving at approximately 15 MPH, the rear passenger door opened inadvertently. The contact stated that the right rear passenger immediately closed the door and later, when the vehicle was parked and the right rear passenger attempted to exit, the door would not open from the inside. When attempting to open the door from the outside, it also would not open and has remained inoperable. The contact added that a few days later while driving at approximately 45MPH the front passenger opened inadvertently. The passenger attempted to close the door but the door did not remain closed. The vehicle was steered to the side of the road and when he existed the vehicle and he pushed the door with force and the door remained closed. The contact also stated that the soft close feature did not work as intended after the failure. The vehicle was not diagnosed or repaired. The contact believes the failure is associated with NHTSA Campaign Number: 17V328 (Latches/Locks/Linkages). The manufacturer was notified of the failure. The failure mileage was approximately 68,000.

The contact owns a 2008 BMW 750LI. The contact stated that upon refueling the vehicle, he smelled a strong gas odor. The contact recalled that the same issue had occurred with a BMW vehicle that he previously owned, so he drove the vehicle to his residence and restarted it. The contact exited the vehicle and as he was looking around, he noticed fuel leaking onto the rear driver’s side wheel and onto the floor. There were no warning lights illuminated. The dealer was notified of the failure and informed the contact that his vehicle was not included in a recall. The dealer advised the contact to take the vehicle in for diagnosis; however, the vehicle was taken to an independent mechanic who diagnosed that the fuel pump was fractured and needed to be replaced. The manufacturer was not notified of the failure. The vehicle was not repaired. The approximate failure mileage was 112,000.

I DROPPED OFF MY 2008 BMW 750 LI ON OCTOBER 11, 2018 TO THE CONCORD BMW DEALER FOR THE DOOR LATCH RECALL. RECALL # 17V-328. I HAD MENTIONED TO THE SERVICE WRITER THAT THE PASSENGER SIDE FRONT DOOR AND DRIVER SIDE REAR DOOR NOT CLOSE COMPLETELY SOMETIMES. AND OCCASIONALLY BECOME HALF CLOSED AND DASHBOARD WARNING LIGHT ON WHILE DRIVING. THE SERVICE WRITER SAID HE WILL CHECK ALL 4 DOORS FOR THIS RECALL. WHEN I PICK UP THE VEHICLE ON OCTOBER 12, 2018, I DISCOVERED THAT THE 2 DOOR LATCHES THAT STILL NOT WORK PROPERLY. I TALKED TO THE SERVICE WRITER REGARDING THE DOOR LATCHES STILL HAVE THE SAME PROBLEM PRIOR TO LEAVING. HE EXPLAINED TO ME THAT THE RECALL IS ONLY FOR REPROGRAM THE DEFECTIVE CODE AND IT DOES NOT COVER THE DOOR LATCH NOT WORK REPAIR. I WOULD LIKE TO KNOW IF THE REPROGRAM IS A SOLE REMEDY FOR THIS SAFETY RECALL. ENCLOSED PLEASE FIND A COPY OF THE CONCORD BMW DEALER'S INVOICE # 888479 DATED OCTOBER 12, 2018. I ONLY HAVE 88,900 MILES ON THE CAR. THIS SEEMS TO BE A MANUFACTURING ISSUE ON 750 SERIES MODELS FROM 2005-2008. THERE SHOULD BE A RECALL FOR THIS, AS IT'S COSTLY AND VERY DANGEROUS TO DRIVE WITH.

AFTER DROPPING MY DAUGHTER (WHO WAS SITTING IN THE REAR SEAT OF MY CAR) TO HER SCHOOL IN THE MORNING, I WAS DRIVING TO WORK. I CONFIRMED THAT ALL THE DOORS WERE CLOSED AND LATCHED AFTER SHE EXITED THE CAR. JUST BEFORE REACHING MY WORK LOCATION, THE DRIVER SIDE REAR DOOR UNEXPECTEDLY OPENED WHILE THE VEHICLE WAS IN MOTION. AFTER STOPPING, THE OPEN DOOR COULD NOT BE CLOSED OR LATCHED AGAIN. I CALLED BMW USA ABOUT THE PROBLEM AND THEY TOLD ME THERE IS AN ACTIVE RECALL ON MY CAR (US NHTSA CAMPAIGN ID - 17V328000) AND I SHOULD TAKE MY CAR TO DEALER TO FIX. I HAD TO TAPE THE DOOR SHUT AND TAKE THE CAR TO DEALER TO FIX THE PROBLEM. I CANNOT IMAGINE WHAT WOULD HAVE HAPPENED IF THE DOOR HAD OPENED WHILE IN MOTION WHEN MY DAUGHTER WAS SITTING IN THE REAR SEAT. THE EXPERIENCE HAS BEEN VERY SCARY.
