VEHICLE SPEED CONTROL

COMPONENT FAILURE: The engine, power train, and speed control systems failed due to the known Nu 2.0L GDI connecting rod bearing defect. SAFETY RISK: My [XXX] daughter was driving in heavy rush-hour traffic when the vehicle suddenly lost motive power and entered a 20 MPH "limp mode." This sudden deceleration created an immediate and severe risk of a rear-end collision, endangering my daughter and surrounding motorists. DEALER CONFIRMATION: The failure was officially confirmed by Flow Kia of Charlottesville (RO #XXX). On Dec 3, 2025, the dealer confirmed active DTC P1326 (KSDS) and documented failed cylinder compression (as low as 150 PSI; min spec is 178 PSI). The dealer issued a written diagnosis stating: "engine replacement is required." MANUFACTURER CONDUCT: Despite their own dealer's written diagnosis and the active P1326 safety code, Kia Corporate issued a bad-faith warranty denial. The dealer also unlawfully charged me $165 for the mandatory KSDS warranty diagnostics. SUMMARY: This is a textbook safety failure under NHTSA Investigation EA 21-003. Kia's refusal to replace the engine under the court-supervised Engine Litigation II settlement represents a systemic failure by the manufacturer to remedy a known safety hazard. 51-page evidence packet attached. VEHICLE SPEED CONTROL

In March 2025, my 2022 Kia Soul developed a check engine light and drivability problems that progressed to rough idle, loss of power, reduced power with limited speed and an unresponsive throttle, and stalling after continued driving. The vehicle was taken to the dealership, and the dealer performed a major timing related repair (camshaft and related timing/CVVT components) under on 03/07/2025. In January 2026, the check engine light returned and the dealer’s printout shows timing correlation related codes again (P0014 shown as pending and P0017 stored as history). Because the prior event involved loss of power and stalling, I stopped driving the vehicle immediately and brought it in as soon as the dealer had an opening to avoid a repeat safety incident. The dealership has stated the condition is due to low oil or excessive oil consumption and has recommended either engine replacement or additional major timing/engine repairs to make the vehicle drivable. I am concerned this is a recurring engine timing or engine control condition that can lead to reduced power and stalling while driving. I am also aware of recalls or manufacturer campaigns reported for similar Kia Soul vehicles involving engine oil consumption or related engine damage concerns, but my VIN does not show as included. Given the repeat timing related codes and prior reduced power and stalling, I am requesting review of whether this condition warrants broader investigation beyond the current VIN scope.

The Instrument Cluster, the Speedometer and "NOW" the Odometer are not working--absolutely dead. "NOW" is in caps because to my surprise I noticed just recently that the Odometer is not working. In April 2021, after several weeks of waiting for the repairs to be finished, a Kia dealer, PEAK KIA in Colorado replaced the Instrument Cluster because of the faulty Speedometer. (This repair was done after several months of back and forth to more than one Kia Dealer about this problem. Unlike now where the Speedometer is dead, not moving at all, at that time it would stop working periodically, perhaps when my car was cold or not. It took several months of dealing with Kia dealerships to acknowledge that it was a problem.) Right after the replacement in 2021, I texted the PEAK KIA mechanics-representative, named Trevor, that it was still a problem, not working every now and then. He replied in a text "What?" and that he would check with his technician. He never got back to me with an answer, and would not return my phone calls.) Since that time, I've been dealing with this infrequent or sometimes-problem. Note, I work from home so I do not drive my car every day, only once or twice a week. However, just recently before and around the holidays, I noticed first that the Speedometer was dead, the needle was not moving at all during the entire time of driving, instead of every now and then. And closer to the holidays, I was shocked, noticing that the Odometer was NOW not moving. This had never been the case before. To date, I only have a Powertrain Warranty(?) left that expires in December 2028. I called Kia, the manufacturer, the other day and reported the above information. They said too bad, they will not cover it because the warranty for that 2021 repair expired 12 months after the repair, something I did not know. My concern is whether the Kia Dealer, Arapahoe Kia--where I usually go , will or should cover it. Plus, I feel this is a serious safety issue.

Summary of Safety Defect: While my 16 year old daughter was driving our 2014 Kia Soul in December 2025, the car suddenly lost power in traffic and would not go over 20 mph; the check engine light came on and the vehicle entered limp mode. The sudden drop in power created a high anxiety, hazardous situation for my daughter, who had only had her license for a week, during rush hour traffic. The vehicle was unsafe to operate and had to be towed. Details of the Incident: Diagnostic trouble code P1326 (Knock Sensor Detection System) was confirmed by the Kia dealership. P1326 is part of Kia’s known engine defect population and is tied to safety related engine failures. The dealership documented oil consumption, oil fouled spark plugs, and compression readings below Kia’s minimum specification on all cylinders. The dealership concluded in writing that engine replacement is required. Despite this, Kia denied warranty coverage based solely on a bearing clearance test, without completing the full diagnostic process required under the KSDS settlement. The vehicle remains unsafe and inoperable. Why This Is a Safety Issue: The sudden loss of power and inability to accelerate above ~20 mph created a dangerous situation for my daughter and surrounding traffic. This is a known defect pattern in Kia vehicles covered under the KSDS program. The failure occurred without warning and could have resulted in a collision. Requested Action: I am reporting this because Kia has not responded to my two complaints nor properly addressed a safety related engine defect that is already part of a national settlement. The incomplete diagnostic process and denial of coverage leave the vehicle unsafe and unusable. I request that NHTSA review this incident as part of the ongoing safety concerns involving Kia GDI engines and P1326 related failures.

While driving my 2013 Kia Soul, it has turned off while I was sitting still several times this month. The RPM gauge has stopped working and than my vehicle would not drive, actually it was driving very slow and not getting enough power to go the normal speed. Also now my cruise control does not come on any longer. I took my vehicle to a Kia dealer, where they claimed that they could fix it, but than after I paid over $2000, they stated that they did not have the parts to fix my vehicle.

2025 KIA Soul Chandler, AZ Crash 1 injured

VEHICLE SPEED CONTROL

While driving, the vehicle began accelerating (forced acceleration) without driver input. When driver attempted to stop or slow the vehicle down, the brakes were unresponsive due to the brake override system failure. Because the vehicle could not be stopped or slowed down, and to avoid hitting or harming others, driver veered off the road which caused the vehicle to flip multiple times and finally stop, landing on the roof. It was noted that the engine was still running at that time. The safety of the driver and others was in immediate risk, as the vehicle could not be controlled. The problem has not been reproduced by a dealer or independent service center. The vehicle has not yet been inspected by the manufacturer, police, insurance representatives or others. There were no warning lamps, messages or other symptoms of the problem prior to the failure.

VEHICLE SPEED CONTROL:CRUISE CONTROL

The contact owns a 2023 Kia Soul. The contact stated that the battery discharge and Auto START/STOP warning lights were illuminated. The vehicle was included in NHTSA Campaign Number: 23V531000 (Power Train), for which the dealer replaced the electric oil pump controller as the remedy. After the repair, the cruise control was unintendedly activated. The Lane Keep Assist feature was intermittently activated independently. While refueling, the fuel gauge was half full and took approximately 30-40 minutes before quickly displaying a full tank. The dealer was contacted and confirmed that the recall repair was completed; however, the vehicle was not taken back to the dealer to be diagnosed or repaired. The manufacturer was informed of the failure and referred the contact back to the dealer. The failure mileage was approximately 33,000.

2016 KIA SOUL- While driving, vehicle lost power, check eng light came on and vehicle would not accelerate, engine started making noise- pulled over and shut car off. Had vehicle towed to independent shop and was diagnosed with bad catalytic (manifold) convertor- they changed oil and filter and also found metal in oil, which I never experienced till this incident- upon research i found that there was a recall on that convertor, i called dealer, had towed there- diagnosed as convertor, was told covered one day, then called next and told it was not. Evidently, looking at reviews and complaints, there are many people driving 2016 kia souls that were not covered under this catalytic recall. Seems that Kia never fixed the original issue. Warning DON'T BUY A KIA- I have contacted Kia customer care, case [XXX] and they have said car did not have recall and are not giving any assistance. Subject: Possible Design Flaw in Accelerator Pedal – Kia Soul 2015 Dear Kia/NHTSA Representative, I am the owner of a 2015 Kia Soul and would like to report a concern regarding the design of the accelerator pedal. I have observed that when the vehicle is turned on and in “Park” mode, the accelerator pedal can be easily pressed unintentionally simply by moving the foot slightly while seeking a more comfortable position. This appears to be related to the low and forward positioning of the pedal, combined with the soft sensitivity of the electronic throttle system. As a driver, I believe this design may lead to unintended acceleration in certain situations, especially if one is not fully aware of their foot placement. There also seems to be no sufficient space to the right of the brake pedal to rest the foot without nearing the accelerator. While I have not experienced an incident as a result, I believe this characteristic may pose a safety risk to some drivers and could become a distraction either while driving or while the engine is idling. I respectfully request that this matter be reviewed by Kia’s technical team and, if appropriate, considered for design revision or future updates. Sincerely, [XXX] [XXX] [XXX] INFORMATION REDACTED PURSUANT TO THE FREEDOM OF INFORMATION ACT (FOIA), 5 U.S.C. 552(B)(6)

My car keeps losing a major amount of oil and has been doing that before the correct date or miles is due for a new oil change and then my car makes a funny noise. It has issues when I accelerate, it langs, it takes longer to get up to speed and the shifting sometimes is loud and behind, my rpm goes really high and I'm going no where at times. My air conditioner also makes a really bad humming sound on when turned up. Not exactly sure on date when started honestly. It's been some months now.
