I am submitting this updated complaint regarding ongoing issues with Safety Recall 69PZ (Passenger Occupant Detection System) on my 2024 Volkswagen Atlas Cross Sport. Despite multiple repair attempts at Gossett Volkswagen in Memphis, TN, the recall remains incomplete, and the vehicle now exhibits additional safety‑system failures that began immediately after dealership service. I purchased the vehicle from Gossett Volkswagen and have had all warranty and recall work performed exclusively at this dealership. The first recall attempt occurred on April 20, 2026. The second attempt occurred on April 29, 2026, when the dealership picked up and returned my vehicle; this visit is confirmed by home security footage and text messages, but no repair order was issued. A third attempt on May 4, 2026 was also unsuccessful. On May 8, 2026, the dealership produced a repair order stating “SUCCESSFULLY COMPLETED RECALL,” but later acknowledged in writing that the recall was not complete. On May 18, 2026, another repair order inaccurately stated that I “declined” the recall. Immediately after the [XXX] visit, my vehicle displayed new safety‑system errors, including Drivetrain Error, Emergency Assist Error, and Front Assist Error. These issues were not present before the visit and were documented on video. On May 20, 2026, during a recorded call, the Service Manager stated that the dealership would not schedule, diagnose, or repair any issues on my vehicle unless I authorized the recall repair, even though the new defects are unrelated to the recall and should be covered under warranty. He also stated the dealership is a “private company” and can refuse service. As a [XXX] who relies on custom hand controls, these unresolved safety issues and the dealership’s refusal to perform warranty repairs have left me with an unsafe and unreliable vehicle. I was involved in a frontal collision in my 2024 Volkswagen Atlas Cross Sport that resulted in severe front-end damage. The vehicle was declared a total loss. During the crash, the driver steering-wheel airbag did not deploy. Based on the severity of the impact and damage, airbag deployment would normally be expected. I purchased my 2024 Atlas Cross Sport back in March of 2024. Within the first two weeks, the 5F module that controls the entire infotainment screen went out. They completely replaced the module. Since then, I have had it in the dealership several times due to the screen completely blacking out. We are unable to see any air conditioning controls(like defrost), backup camera, or vehicle information. We have went back and forth several times about whats causing it. First there was a "recall" that a software update was suposed to fix. We had in in and they applied the update. Less than a week later, the screen blacked out again. We took it back into the dealership. They had it for another week and said that they could not replicate the issue so nothing was wrong. They then started blaming our cellphones telling us that we cant have them plugged in or connected wirelessly. The following week we kept all of our devices disconnected and had the issue happen AGAIN. We took it back and after two more weeks of repairs they replaced the entire 5F module again. Less than 24 hours after picking it up we got an airbag error. We were able to take a picture and send it into the dealership. They informed us that its a known issue and to try driving it around with nothing in the front seat. So at this point we are unable to use half of the cars capabilities and apparently not allowed to have anything laying in the passenger seat because it causes an error bag error. So we are basically driving this vehicle around not knowing wether or not the airbags would deploy in an accident. We are beyond fed up with the excuses the dealership is giving us and feel completely unsafe driving the vehicle. I found where they recalled almost 300,000 atlas SUVs last year and apparently had a recall to fix the issue. Ours should have been fixed but we are just told to not put anything in the seat to prevent the error.

I received notification via carfax, VW app, AND by mail about the passenger air bag faulty PODS system recall in September 2024. I was told by my local dealership there was no active fix for the issue at the time. I then had my 50k mile service completed in December 2024 the week before Christmas and the service department stated they still had not received a fix for the recall code and that it would be rolling out in stages and to wait for a resolution. It is now March 2025 and I do not feel safe driving this vehicle with my family knowing there is a possibility of the airbags not deploying in the event of a car accident. The website even suggests not to drive the vehicle with this recall.

Car dealership attempted to fix recall related to Passenger Occupant Detection System (PODS). Dealership technicians experienced issues completing the repair and contacted the vehicle manufacturer for assistance. The manufacturer claims that the issues experienced during repair are due to damage and are refusing the pay for any fix to the recall. I am not aware of any damage the system would have experienced, other than being known to be defective and under recall. The manufacturer's proposal is that I pay approximately $1,300 to replace the system, which is known to be defective and under recall, or accept my vehicle back with a faulty PODS. It is the manufacturer's responsibility to replace this system, which is known to be defective and under recall. The nature of the problem is extremely serious and could involve injury or loss of life to my family. Therefore, I am not willing to accept the vehicle back with a defective PODS.

I own a 2021 Volkswagen Atlas Cross Sport that more recently in June 2024 received a recall on its Passenger Airbags stating that it may not function properly in event of a crash. I want to point out that this is the only vehicle in the family and teenagers do ride in the front seat. I was informed of the recall via my Progressive App in June 2024 and Volkswagen who issued the recall did not inform me until end of August 2024 a 3 month delay. I have been in communication with Volkswagen Corporation to work together to come up with a plan to resolve the issue in a manner that would work for both parties. I was notified by Volkswagen on December 4, 2024 that a repair for my vehicle is available and I should contact my local VW dealership to make an appointment to get this recall repaired. I made an appointment with VW of Olympia for the repair of the recall on December 10, 2024 and at this time they are refusing to make the repair. I am concerned about the safety of my teenagers who ride on the passenger seat. This 2021 VW Atlas Cross Sport is the only vehicle in the family and at this time neither the VW nor the dealership are offering any alternatives nor loaner car disregarding safety of my teenagers who ride in the passenger seat. I am asking NHTSA to be involved to help offer a resolution so that I can get this recall remedied in a timely manner. I appreciate your time. I want to point out that this is the only vehicle in the family and teenagers do ride in the front seat. I was informed of the recall via my Progressive App in June 2024 and Volkswagen who issued the recall did not inform me until end of August 2024 a 3 month delay. I have been in communication with Volkswagen Corporation to work together to come up with a plan to resolve the issue in a manner that would work for both parties. I was notified by Volkswagen on December 4, 2024 that a repair for my vehicle is available and I should contact my local VW dealership to make an appointment to get this recall repaired. I went in person to VW of Tacoma, I made contact with one of their representative (not sure if this person even worked there as she had no proper name tag or proper VW uniform). The whole process seemed non transparent as when I asked for her name she would not give her name despite of multiple requests. My experience with this person was very nerve racking as it was unclear if I was being subject of fraud. I specifically asked to speak to the manager whose name was Jerry Podgoski. Despite of the information regarding the availability of the my recall repair part the dealership still refused to provide repair for my vehicle's recall. Jerry Podgoski gave me the false idea that their dealership would be in touch however to date I have not heard back. I later found out the name of the service tech who refused to give her name was Maile Magpoc, she was not a pleasant person to deal with and the whole interaction seemed shady. I would like NHTSA to be involved as the recall from VW involves airbag and from the information I received from VW America repair is available and VW of Tacoma is refusing to provide the repairs on the recall issued by VW of America.
