On May 28, 2025, my 2023 BMW X7 underwent BMW recall B340224. Repair Order 669956 specifically states: “0077067 REPLACING INTEGRATED BRAKING SYSTEM.” After this recall repair and replacement of the Integrated Braking System, the vehicle began experiencing abnormal and potentially dangerous braking behavior that did not exist before the recall repair. The brake pedal can initially feel unusually soft or have excessive travel, followed by sudden and aggressive braking. In slow traffic and stop-and-go driving, the brakes can also feel as if they are sticking or not releasing normally, causing the vehicle to jerk when stopping or starting. The problem is significantly worse in hot weather and heavy traffic. After approximately 10 miles of highway driving, the braking behavior may temporarily improve. I have repeatedly reported that these symptoms began after BMW replaced the Integrated Braking System under recall B340224. Despite multiple service visits and substantial repairs, the safety problem remains unresolved. Most importantly, I have repeatedly asked BMW to investigate the Integrated Braking System that was replaced under the recall as the possible source of the problem. BMW has not properly investigated or addressed that component despite the clear timing between the recall repair and the onset of the braking symptoms. Most recently, the vehicle was left with the BMW dealer for approximately one week regarding this continuing safety complaint, but no repair or meaningful inspection of the Integrated Braking System was performed before I retrieved the vehicle. The vehicle and the replaced braking system remain available for inspection. I am requesting that NHTSA investigate whether the Integrated Braking System replacement performed under recall B340224, or the recall remedy itself, may be related to this continuing braking safety defect.

Subject: Failure to Perform Safety Recall 24V-739 / Brake System Failure Description of the Problem:"My 2024 BMW X7 (VIN: [XXX] ) is currently experiencing a critical failure of the Integrated Brake (IB) module, which is part of the active Safety Recall 24V-739. The dashboard displays the message 'Drive carefully. Brake system.' I have contacted BMW AG [XXX] ) and BMW North America multiple times over the past 3 weeks, but they have failed to provide authorization for the repair at the authorized service center (Improtex Motors). The manufacturer is knowingly allowing a vehicle with a life-threatening brake defect to remain on the road by delaying the recall remedy. This is gross negligence regarding a mandatory safety recall." Sincerely, [XXX] Tel / WhatsApp: [XXX] INFORMATION REDACTED PURSUANT TO THE FREEDOM OF INFORMATION ACT (FOIA), 5 U.S.C. 552(B)(6)

The contact owns a 2024 BMW X7. The contact stated that while his wife was driving, the braking system malfunctioned, and the vehicle hesitated to respond upon depressing the brake pedal. Additionally, the steering wheel became extremely difficult to turn. Several unknown warning lights were illuminated. The vehicle was towed to the local dealer, where a software update was performed, and the vehicle was repaired. The contact stated that the failures later recurred intermittently, rendering the vehicle unsafe to drive. The contact was informed that the VIN was included in NHTSA Campaign Number: 24V104000(Electronic Stability Control(ESC), Service Brakes, Hydraulic), but the recall remedy parts were not available. The failure mileage was 10,000.

My 2019 BMW X7 is under Safety Recall 25V-644 for an overheating/fire-risk defect, but the recall remedy is unavailable. The vehicle has now experienced multiple safety-related failures that appear to be progressing. BMW diagnosed the following failures: • Emergency Call System Malfunction • GPS and maps not working • Failure of the TCB telematics module • Failure of the antenna and TCB battery due to fluid ingress • Battery voltage in the red zone • All four tire pressure sensors beginning to fail • Collapsed engine mounts attributed to heat • $11,296 in repair estimates related to electrical and heat damage Immediately after picking up the vehicle from BMW service, a new battery/charging system warning light appeared that was NOT present before the visit. This suggests further deterioration of the electrical system. The combination of: • an open fire-risk recall with no fix available, • fluid ingress damaging telematics components, • multiple electrical and safety-system failures, and • new warning lights appearing after service makes this vehicle unsafe to operate, especially for long-distance highway travel. I am requesting that NHTSA document this as a safety-defect case and assist in ensuring BMW provides a safe resolution.

To:BMW of North America, LLC Customer Relations & Services P.O. Box 1227 Westwood, NJ 07675 Subject: Request for Compensation Due to Prolonged Safety Recall – 2025 BMW X7 (VIN: [XXX] ) Dear BMW Customer Relations, I am writing to formally raise my concern regarding my 2025 BMW X7, which has been subject to an open safety recall since August 2024. It has now been over 13 months without a remedy from BMW. This vehicle was leased through BMW Financial Services with the intent of being used as part of my business operations. Due to the unresolved recall and the associated safety responsibility issues, the vehicle has been restricted from use and rendered inoperable for its intended purpose. Despite this, I continue to make full lease payments, which has placed an unnecessary financial burden on my business for an asset that cannot be utilized. Given the prolonged delay and the material impact on my business, I respectfully request that BMW provide appropriate financial relief or compensation, which may include: •A credit or reimbursement for lease payments made during the period of inoperability, •The option to terminate or exchange the lease without penalty. This situation has been ongoing for well over a year, and I believe BMW has a responsibility to ensure that customers — especially those who rely on their vehicles for business purposes — are not left bearing the cost of a vehicle that cannot be safely used. I appreciate your immediate attention to this matter and look forward to a fair resolution. Sincerely, INFORMATION REDACTED PURSUANT TO THE FREEDOM OF INFORMATION ACT (FOIA), 5 U.S.C. 552(B)(6)

I ATTEMPTED TO HAVE SAFETY RECALL 24V-104(INTEGRATED BRAKE SYSTEM MALFUNTION) PERFORMED AT BMW DEALERSHIP BMW AUSTIN, 7011 MCNEIL DR. AUSTIN, TX 78729-7687 PHONE (512)343-3570 ON AUGUST 28 2025 AT 11;00AM WITH JASON SANTOSUOSSO. THIS SERVICE ADVISORY TOLD ME THE RECALL IS NOT COVERED, BECAUSE MY VEHICLE HAS 36,100 MILES-JUST 100 MILES OVER THE 36,000-MILE FACTORY warranty. HE INFORMED ME THAT BMW 'DENIED" THE REPAIR AND THA I WOULD NEED TO PAY $1900. OUT OF POCKET, (INCLUEDE OIL CHANGE $329), EVEN THOUGH THIS A FEDERAL SAFETY RECALL. AS PER NHTSA REGULATIONS, RECALL REPAIRS MUST PERFORMED FREE OF CHARGE, REGARDLESS OF MILEAGE OR WARRANTY EXPIRATION, REFUSING TO PERFORM A BRAKE-RELATED SAFETY RECALL DUE TO MILEAGE IS NOT ONLY UNREASONABLE BUT APPEARS TO VIOLATE FEDERAL LAW. SUMMARY: INTEGRATED BRAKE: The Integrated Brake (IB) system may not have been produced by the supplier according to specifications. If the IB system was not functioning properly, a warning lamp and message will be displayed in the instrument cluster. In August, this recall was expanded to include additional potentially affected vehicles. SAFETY RISK: In some cases, there will be a reduction in power assist braking, which could lead to an extended stopping distance and increase the risk of a crash. The Antilock Brake System (ABS) and Dynamic Stability Control (DSC) system may not function, which could also affect braking performance as well as vehicle handling and control. However, fully mechanical braking is not affected and, if the IB system is not functioning properly, the parking (emergency) brake will be automatically activated to aid in braking performance and help maintain vehicle stability and control. REMEDY: The Integrated Brake (IB) system will be replaced for free by an authorized BMW center which should take about two to three hours. RECALL STATUS: Recall INCOMPLETE. Remedy not yet available This recall was issued on February 12, 2024, more than a year ago and the manufacturer has informed that the parts to fix this issue is on backorder. This is a safety issue.

I am leasing a 2025 BMW X7 vin number ([XXX]) through BMW Financial Services. The vehicle has had an active federal safety recall since approximately February 2024, and as of today, the manufacturer has not provided a remedy to address the issue. The recall is listed on the NHTSA website but remains unresolved for over 17 months, despite my attempts to obtain information and updates from both the dealership and BMW directly. I believe this is a violation of my consumer rights under the New Jersey Consumer Fraud Act and breach of warranty, as the vehicle has a known safety defect that the manufacturer has failed to repair within a reasonable time. I am requesting assistance in: 1.Reaching a resolution with BMW to either terminate the lease without penalty, or 2.Compelling the manufacturer to provide an immediate remedy. This recall impacts the safety and use of the vehicle, and I am concerned for both my safety and the financial obligations tied to a defective product. The vehicle had a spill in the cup holder. The cup holder has holes and does not hold liquid. This spilled into the electronics underneath and around it. The car suddenly could not be put into park. It would roll when attempting to do so. The electronics control park and the emergency brake from the same electronic panel. Preventing save disabling of the vehicle required chalking to prevent movement.
