RECALL OMISSION & SAFETY DISPUTE (Case #10683843): I am reporting two documented safety defects in my 2008 BMW 328i (N51 engine) that are identical to existing Federal Safety Recalls but have been omitted from the recall VIN list for this model year. 1. AIRBAG SYSTEM FAILURE (Recall 17V-428): The vehicle has a confirmed Fault Code 93C3 (Passenger Seat Occupancy Mat). This is the exact failure mode described in Recall 17V-428. This defect has deactivated the front passenger airbag system, as indicated by the red SRS warning light. The manufacturer has refused to address this as a safety recall, despite the component failing in the identical manner described in the 2006 model year recall. This creates an immediate risk of injury or death to front-seat passengers in the event of a crash. 2. ENGINE STALL RISK (Recall 23V-707): This vehicle utilizes the same aluminum VANOS housing bolts that are currently under Safety Recall 23V-707 for 2010–2012 models. These bolts are known to loosen and shear, causing sudden engine stalling while in motion. Despite the high risk of a high-speed stall and loss of power steering/braking, the manufacturer is excluding 2008 models from the recall remedy. Passenger Restraint system malfunction for the front passenger seat. This may not trigger the airbag for a passenger sitting in the front if a collision occurs and can seriously injure someone. This problem appears to be very common with BMW models within this timeframe. All over car forums and youtube videos, some videos with over 100k views per video. I am not sure how BMW has not recalled this safety issue as it seems to linger throughout many of their models for many years. As soon as the malfuction occured\, the warning sign and lamp lights did flash on.

RE: Recall on 2011 328i Vin# [XXX] I drove the car to run an errand, car was running ok but had a miss. During my drive home, the car stalled. I had to quickly coast to a parking lot in order not to get hit by the car behind me. I tried to restart the car, but it acted as if it needed a jump. Tried to jump the car but it turned over slowly without starting. Ended up getting it towed to Metairie very early the next morning, due to parades. Had a friend of mine, a BMW shop owner, take a look at the car. He told me that he found out that it had a few recalls and he thought that may be the problem. I spoke with a service advisor at BMW dealer that checked the vin and said the recalls would be taken care of along with anything it caused. I made the appointment and had it towed to BMW dea;er. I was assigned to Erin C, Service Advisor, when I made my appointment. My appointment was for 7:30 AM on the 28th of March. I heard from Erin at 4:30 that afternoon with an update. She told me that I had a seized engine and it was going to cost ten thousand or more to replace the engine. I asked if the recall was done on it, because the recall stated that one of the indicators of the Vanos issue was that it would not start any more. I also found information saying that stalling, engine seizing, and oil starvation can be dangerously caused by the recall. Erin stated that they would take the valve cover off to confirm. Didn’t hear from her on Friday, or over the weekend. I got her on the phone Monday evening at 5:30 PM. Erin told me the same information that after they took off the valve cover and videoed it (have not seen that video yet). That my engine was seized. She assured me that they hooked up the car to communicate with the engineers who confirmed, from all the evidence, that the engine seizing was not caused by the recall but lack of oil circulation. The other was a part of the computer pretty much in charge of cooling the car down it can make fire from melting and cause unfixable/ to constant issues .... Well my hole engine stopped working it was getting too hot miss firing coolent mixing with oil and started to smoke it was white smoke that came out didn't smell like anything crazy maybe mostly coolent and pretty much it had electric issues since I got it so the recall issue makes sense so I took it in to bmw Riverside they said they will fix all that and contact me it's been almost 2 weeks I live in my car I'm disabled and a mom I can't even go drive and see my child over this I have no income disabled type thing and no word what's wrong they said they might charge me a few of 287 but I'm disabled no income yet so that's out it tells me it will be fixed free and if the dealer won't fix the electric system on everything in the car and not charge me later like they said they will then I want to sue big time and if that's not dun when clearly safety was in danger fire issues and crap I want the same car but a new one off the lot not brand new car or fix then I'm sueing for my losses that simple

The air bags deployed, and the contact's face struck the steering wheel. The fire department and police arrived on the scene, but the contact was unaware if any reports had been filed. The firefighter escorted the contact out of the vehicle, while smoke came from the engine. The contact was transported to the hospital by ambulance and treated for a fractured nose and teeth, shrapnel in the left eye, bruising on the right shoulder and knee, and a concussion. The vehicle was towed to a tow yard, where the insurance company deemed it totaled and determined that the contact was at fault for the collision. The contact later received notification of NHTSA Campaign Number: 24V513000 (Air Bags). I along with many others are getting a passenger restraint sensor error which prevents the airbag from deploying. This is very dangerous and the repair cost is $2000. This sensor determines if there is an occupant sitting in the front passenger seat and if they meet the weight limit for the airbag to deploy. When it malfunctions, the airbag will not deploy even though a passenger may be seated there.
